This agreement sets out the legally binding Terms and Conditions for the use of the http://recordedinart.com
or any other domain names that are directed to http://recordedinart.com
website and all other services provided by and under the name of Recorded in Art. Recorded in Art domain name is owned by Blue Sunflower Enterprises Ltd.
Recorded in Art is the name used by Blue Sunflower Enterprises
Ltd with regard to this website and all trading and terms and conditions
in this document.
Recorded in Art or Blue Sunflower Enterprises Ltd reserves the
right to update or change the Terms and Conditions from time to time
without notice.

All prices are in £ Sterling. Recorded in Art is not currently registered for VAT, therefore prices do not include VAT.
In addition to the above, there are customary shipping
charges payable, these charges will be specified in the order. When
products are purchased in our web shop, please be aware that the product
will be shipped directly from our office located in London UK. These
costs will be indicated when you select your country of choice for
delivery.
Apart from the shipping costs, please note that there may in
addition, be imposed custom tariffs and other import levies if you order
a product from Recorded in Art for outside the European Union. Please
note that these fees will be charged separately from shipping costs
related to delivery.
The price of a product is the price as at the date and time you place your order.
Recorded in Art reserves its rights in relation to typing errors, pricing
errors, VAT, currency and tax changes, price increases, force majeure,
sold out/deleted articles and delivery failure for other reasons.
Recorded in Art accepts the following payment methods: Stripe, PayPal, Cash
and Bank Transfer. For other preferred payment methods you can email us
at
admin@recordedinart.com If you wish to pay by cheque, goods will not
be dispatched until the additional 5 working days has passed that it
takes for cheques to clear or until the cheque has cleared.

The full purchase price must be received for all orders before they can be processed.
If a
product is sold out, this will normally be stated, but we reserve the
right to specify this in any subsequent e-mail. We also reserve the
right to confirm that we have sent the rest of your order in any number
of residual orders if delivery of the product can be affected within a
period of 7 days from the day the order is sent out.
Recorded in Art will offer a choice of shipping and postage options at point of checkout.
We recommend that you choose a sign for, recorded delivery or
courier service to ensure that your product is trackable at all times.
You accept that should you decide to use standard postal
service Blue Sunflower will provide proof of postage and is no longer
liable for any loss or damage of the item beyond the point of postage.
If you wish to collect your goods in person or arrange
alternative shipping/postage/courier please choose ‘NONE’ and contact us
at
admin@recordedinart.com
Your goods will not be dispatched until the alternative
shipping/postage/courier has been arranged and payment for alternative
service has been received should there be a chargeable service involved.
It is up to you as the customer to provide Recorded in Art with the correct delivery address for us to dispatch your item to.
When
confirmation of order is received it indicates that we have received
your order. It does not indicate that a contract exists between us. We
will indicate acceptance of your order, and hence a contract between us,
when we send you an invoice via email. We have included this term to
protect us in the case that a mistake has been made in pricing, we have
inadvertently under-priced goods, or we are no longer able to supply a
particular product for some reason. In the case of a change of price, we
will always contact you first to ensure that the price is acceptable.
In
the case of ordering limited edition prints of postcards you accept
that once we have received your order and your payment has been
processed, a confirmation of order will be sent out to you via email.
Once
Recorded in Art has received the printed order the prints will be signed
by the artist and the sequential number of each individual print noted
on the artwork according to how many prints of that particular image
have already been printed.
As soon as the final print in the stated number of prints in the Limited Edition Series of that particular image has been
printed and signed off, no more copies of that Postcard will be printed
and the image will become unavailable and marked as sold out.
You
also accept that due to fact that the prints will effectively be posted
twice, once from the printers to the artist, then again to you the
customer once they have been signed, your prints may take a few days
longer for you to receive than normal.
Where possible, we will send orders the same day they are received. For UK mainland, please allow three to five working days. Please allow longer for overseas orders.
Upon
receipt of the product you are obliged to, within a reasonable time to
examine the product to ensure that it matches your order.
If the received product is defective, please send an e-mail to admin@recordedinart.com as soon as possible, we will then send you instructions.
When contacting us please state your name, address and order
number. Furthermore, please indicate the reason for your enquiry. Please
also provide where possible photographic evidence of the defect as this
will help in determining the nature of the defect and when and where
the defect may have occurred. Once we have received your enquiry we will
contact you by e-mail.
It is essential that these defects are not
caused by incorrect use of the product or other damaging behaviour.
Furthermore, the defect must have been present when you received the
product. Complaints must be made within a *reasonable time after the
discovery of the defect.
* Reasonable would normally be considered a period of 14 days from receipt of product.
As
a consumer you have the right to cancel the purchase. The right to
cancel an order must be exercised within 8 days from the day of receipt
of the product. The right to cancel an order can only be used if the
product is returned in the same condition and quantity as it was
received. The right to cancel an order lapses where product has been
used or a period of more than 8 days has passed since receipt of the
product.
When you use the right to cancel an agreement, you must pay
for the shipping costs yourself when you return the product. Products
not returned in accordance with above requirement will be rejected.
Products must also be returned in its original packaging or packaging to
a similar or better standard. Products returned in unsuitable or
inferior quality packaging may negate our refund policy as they become
damaged in transit. Recorded in Art does not accept responsibility for
returned packages and will only refund goods that are received in the
same condition and quantity as they were dispatched.
If you wish to return a product please send an e-mail to admin@recordedinart.com,
before taking any further steps or dispatching your product back to us.
Upon receipt of your e-mail we will send you instructions.
Please note that you are responsible for the product until
Recorded in Art receives the product. For you own sake, we therefore
recommend that you return the product in a manner which will ensure that
you are refunded the full value of the product.
When you return products, please quote the name, address,
e-mail address and order number. In addition, please indicate the bank
account details in which the refunded amount should be deposited into.
We will NOT refund your expenses for freight/transportation.
Once we have received the product and checked that it meets
the conditions for the right to cancel, we will refund to you with the
amount. Please note that this process may take up to 7 working days or
more depending on where the product(s) have been sent to.
If we do not believe that the conditions for cancellation have been met, we will send you our reasons by e-mail.
If for any reason we receive your returned product(s) and
cannot accept the conditions for refund and consequently you decide that
you wish to keep the product(s), Recorded in Art will NOT be responsible
for the costs incurred returning the products to you. You will need to
make additional payment to cover the return of returned goods
postage/carriage fees. We will hold your ‘ineligible for refund’
returned goods for a maximum of 3 months from the date that we receive
the returned goods, and should the return of the returned goods payment
not be received, the goods will revert to the ownership of Recorded in Art and Blue
Sunflower Enterprises Ltd to do with as they please.
Trading
on Recorded in Art requires that you fill in the following personal
data: name, address, phone number, e-mail address and credit card
information.
You have the ability to choose an address for delivery which is different from the address and place of payment.
If we find inaccurate information, we reserve the right to cancel the transaction.
Please
note that personal data is recorded for the purposes of delivering your
order, or for sending you information if you have agreed to receive
such information. By accepting our Terms and Conditions you also agree
to the registering of your personal data through our web site for the
purpose of handling your order.
No other sensitive personal data is recorded.
Recorded in Art does not disclose buyers' information to third parties.
We will never forward any details for marketing purposes to any third party.
We
are committed to protecting your privacy. We will only use the
information that we collect about you lawfully (in accordance with the
Data Protection Act 1998).
We collect information about you for 2 reasons: firstly, to
process your order and secondly, to provide you with the best possible
service.
We will only e-mail you in the future if it concerns your
order. If you have a particular interest in fine art or purchased work
by one of the artists who exhibit in the gallery, we may forward
information about the artist and any upcoming exhibitions that relate to
your order and/or artist. In our experience people like to know a
little more about art they purchase.
The information we hold will be
accurate and up to date. You can check the information that we hold
about you by emailing us. If you find any inaccuracies we will delete or
correct it promptly
Cookies
are necessary for use of Recorded in Art. We use cookies to register
current session information, but do not use permanent cookies.
We may
use technology to track the patterns of behaviour of visitors to our
site. This can include using a "cookie" which would be stored on your
browser. You can usually modify your browser to prevent this happening.
Our
website may contain links to other websites. We can not be held liable
for breaches of integrity or content on these websites – we simply
provide the links to make it easier for our visitors to find more
information within specific areas.

cannot guarantee that the colours shown on the website exactly reflect
the colours of the actual products, The colours seen from our website
will partly depend on the colour reproduction on your computer.
All
intellectual property rights, including the exclusive right of making
available and any reproduction of content including text, graphics and
images, designs etc. contained in this website is protected by copyright
belonging to Blue Sunflower. The pictures of the artworks, the interior
shots and detail shots are not to be reproduced without our approval.
